“Family Kicks – Hockey Month” Contest
OFFICIAL RULES
How to enter:
NO PURCHASE NECESSARY.
To enter the “Family Kicks – Hockey Month” contest (the “Contest”), go to www.family.ca and click on the [www.family.ca/kicks] link. Enter your first name, last name, city, province, e-mail address, age and telephone number. The contest runs from 9:00 a.m. Eastern Time (“ET”) on December 4th, 2009 to 12:00 p.m. ET on January 8th, 2010 (the “Contest Period”).
If you do not have access to the Internet but would like to participate in the Contest, you can enter the Contest by sending a letter by mail with your full name, telephone number, province of residence, and age. The entry will be submitted on the day it is received by The Family Channel Inc. (“Sponsor”), provided it is within the Contest Period. Send mail entries to:

An entrant under the age of majority in his/her province of residence must have a parent or legal guardian consent to his/her participation. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, the entry will be disqualified.
The contact information collected by Sponsor with your entry will only be used to identify and contact the prize winners. Sponsor will not use this personal information for any other reason, nor will Sponsor disclose this personal information to any other party.
All Contest entries are eligible for the Grand Prize.
Eligibility:
The Contest is open to permanent residents of Canada only, excluding residents of Quebec, and employees, and their immediate family members or persons with whom they are domiciled, of Sponsor and the National Hockey League (the “NHL”), NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC and the member clubs of the NHL (collectively, the “NHL Entities”), their subsidiaries or affiliates, and the advertising and promotional agencies involved in this Contest. The Contest is subject to all applicable federal, provincial and municipal laws. Contest void where prohibited by law.
To be considered for the Grand Prize, entries must be received by Sponsor no later than 12:00 p.m. ET on January 8th, 2010. Sponsor is not responsible for entries that are lost, misdirected, stolen, delayed, incomplete, garbled or received after the contest deadline.
There is a limit of one (1) entry per person, per day during the Contest Period. Only one e-mail address and account may be used by any one person to enter the Contest. In the event that Sponsor receives more than one entry per person, per day throughout the duration of the Contest Period, Sponsor reserves the right to void and destroy all entries received in excess of the allowed amount, and that entrant may, in the Sponsor’s sole discretion, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Sponsor also reserves the right to disqualify any such entrant from future contests conducted by the Sponsor without further notice. By submitting an entry, entrants agree to be bound by these Official Rules.
In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of that e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question.
PRIZES
Four (4) random Grand Prize draws will be held at or around 3:00 p.m. ET on January 11th, 2010 at Sponsor’s office located at Brookfield Place, 181 Bay Street, Toronto, Ontario, from all eligible entries received during the Contest Period. The chance of being selected to be eligible to be a Grand Prize winner depends on the total number of eligible entries received by either of the methods of entry.
Grand Prize:
There are four (4) Grand Prize packages available to be won. Each prize consists of:
A trip for four (4) to one of the following cities closest to the Contest winner’s residence, either Calgary, Edmonton, Toronto or Ottawa, four (4) tickets to a National Hockey League (“NHL”) game, 2 nights accommodation and $250 CAD cash. Travel dates and city will be selected by Sponsor in its sole and absolute discretion.
- Round-trip economy class air transportation for four (4) between the major Canadian international airport closest to the winner’s residence in Canada and the airport closet to the selected city. All round-trip airline tickets will be issued for the same flight. Airline tickets are non-transferable and any changes will be subject to availability and could result in additional costs which will be the responsibility of the Contest winner. Any necessary travel documents are the responsibility of the winner. If the winner does not reside far enough away from the selected city to qualify for air transportation, as determined by Sponsor in its sole and absolute discretion, Sponsor will provide alternate transportation to the selected city.
- Two (2) nights hotel accommodation with one room, quad occupancy (to be selected by Sponsor in its sole discretion). A valid credit card (or cash deposit, as set out by the hotel) will be required at hotel check-in. Taxes resulting from the accommodations are included in the prize, however incidental costs incurred by the winners and their guests, including but not limited to meals, phone calls, laundry, room service, alcoholic beverages, merchandise, souvenirs, gratuities and movies are the responsibility of the winners and their guests. Hotel accommodations are subject to availability.
- Four (4) tickets to a NHL hockey game in the selected city (Calgary, Edmonton, Toronto or Ottawa).
- $250 CAD cash.
- One autographed jerseyof a player on the team representing the selected city, as selected by Sponsor in its sole discretion.
Approximate Retail Value (“ARV”) of each Grand Prize is $4,000.00 CAD. Some restrictions may apply.
If the selected entrant is under the age of majority in his/her province or territory of residence, he/she must be accompanied on the Grand Prize trip by a parent or his/her legal guardian who agrees to be fully and legally responsible for such selected entrant.
By entering this Contest the Contest winner (or his/her parent or legal guardian) agrees, represents and warrants that Sponsor and the NHL Entities are not responsible in the event of the cancellation or postponement of any activity relating to any prize for any reason. If any activity is cancelled or postponed, the balance of the prize will be awarded without that element of the prize, in full satisfaction of the prize award.
The winners and their guests will be responsible for obtaining any required travel and health documents (which must be valid prior to and for the entire duration of the trip), transportation to and from the departure airport or other departure location, gratuities, applicable taxes, travel insurance incidentals and all other expenses not specifically mentioned above.
All costs, expenses and fees not specifically included above as part of each Grand Prize package including, but not limited to, cancellation fees, taxes, departure taxes, other travel related taxes and fees, duties and levies, meals, telephone charges, other room charges, incidental expenses, medical expenses, other items of a personal nature, additional optional excursions, gratuities and insurance are the sole responsibility of each Grand Prize winner and his/her guests.
All travel documentation is the responsibility of each Grand Prize winner and his/her guests and the Grand Prize will be forfeited if such documentation is not provided. Reservations will be arranged by the Sponsor. Dates of travel may not be changed, except by the Sponsor in its sole discretion. Lost or stolen tickets and travel vouchers will not be replaced. The Grand Prize winners and their guests must travel together and depart from and return to the international airport, or other departure location, nearest to the Contest winner’s residence in Canada serviced by the airline, or other transportation provider, selected by the Sponsor. It is strongly recommended that the Grand Prize winners and their guests purchase independent travel insurance for medical, accident and baggage coverage.
Acceptance of Prize:
Before being confirmed as a winner, selected entrants must correctly complete a mathematical skill-testing question without assistance of any kind, whether mechanical, electronic or otherwise and must sign a declaration confirming compliance with these Official Rules and acceptance of the prize as awarded, and a release form (together the “Declaration and Release”) that Sponsor, the NHL Entities and their affiliates, associates, respective agents, employees, officers and directors are not responsible for any injury, accident, damage, claim, liability, loss, expenses, including reasonable attorneys’ fees, or misfortune related to any aspects of the Contest or any prize or any travel related thereto, the acceptance, use, misuse, possession and delivery of the prizes, printing errors, and claims based upon publicity rights, defamation or invasion of privacy. If a winner is a minor, his/her parent or legal guardian must sign the Declaration and Release on his/her behalf in order for the winner to claim his/her prize. Each guest of a winner must also sign a Declaration and Release, or if a guest is a minor, his/her parent or legal guardian must sign the Declaration and Release on his/her behalf.
Selected entrants will be notified by telephone or e-mail within two (2) days of the draw. Selected entrants will then have three (3) days following receipt of notice to contact Sponsor, as instructed by Sponsor, to claim their prize. Should Sponsor not be able to contact the selected entrant or not receive confirmation within three (3) days thereof, or should a selected entrant be unable to correctly answer the skill-testing question or complete the Declaration and Release by the date specified, the selected entrant will be deemed to have forfeited any rights to the prize and an alternate winner will be selected, in which event the foregoing provisions of this sentence shall also apply to such other eligible entry. All prize taxes, if any, are the responsibility of the winner. Limit one (1) prize per person or household.
Sponsor will not be held responsible for the failure of a winner to receive his/her prize due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address.
Sponsor or its appointed designee shall deliver the prizes to the winners.
GENRAL CONDITIONS
Prizes must be accepted as awarded and may not be exactly as described. Sponsor, in its sole discretion, reserves the right to substitute any portion of a Grand Prize package with a prize of equivalent or greater approximate value. Some restrictions may apply. Prizes are non-transferable, non-refundable and have no cash value.
All entries become the property of Sponsor and will not be acknowledged or returned.
Each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the contest and accepting a prize, the winner, or the parent or legal guardian of the winner, and the winner’s guests (or the parent or legal guardian of the winner’s guests) hereby consent to the reasonable use by Sponsor of the winner's and the winner’s guests’ name, age, voice, likeness and contents of the winner’s entry form without any further compensation for any future promotional activity. Each entrant consents and agrees to Sponsor’s collection and use of the information provided by the entrant for the purpose of administering this Contest. Each entrant agrees to be bound by these Official Rules.
Sponsor, the NHL Entities and each of their respective officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, sponsors, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance or use of any prize, travel related thereto or from participation in this Contest.
Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winners and the distribution of any prize. Sponsor is also not responsible for the incorrect or inaccurate entry of information which may affect an entrants’ ability to get through on the Internet during the Contest Period or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Official Rules.
Sponsor reserves the right, in its sole and absolute discretion, to cancel, modify or suspend the Contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the Contest, without obligation or prior notice. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered, illegible, incomplete or tampered with in any way. Sponsor is not responsible for the preemption, cancellation, or interruption, in whole or in part, of any Contest-related programming.
