This web site and the Activity are governed by the Family Channel Inc. (“FAMILY”) Legal Disclaimers and Terms and Conditions of Use and Privacy Policy. PLEASE READ THE DISCLAIMERS AND TERMS AND CONDITIONS CAREFULLY. Your access and use of this site constitutes your full acceptance and compliance with the Legal Disclaimers and Terms of Use, the Privacy Policy, and the following Additional Terms of Conditions of Use (collectively, the “Terms of Use”). If you and/or your parent or custodial guardian ("User" or “you”) have not already done so, please take some time to familiarize yourself with these provisions. If you do not agree with these terms and conditions, DISCONTINUE ALL USE OF THIS SITE IMMEDIATELY.
Additional Terms and Conditions of Use
1. Security
We protect your personal information using security systems including appropriate technological, physical and organizational security procedures. Any personal identifiable info collected from Users, including your image as captured in the Activity, is for purposes of the Activity only. We will never provide access to any of this information to third parties unless that party is acting on behalf of FAMILY.
Any information or material that you provide while using the Activity is stored in a secure database and is only accessible by those at FAMILY, or a third party acting on behalf of FAMILY, who need access to it and anyone with access is bound by confidentiality requirements and must treat the information in accordance with FAMILY’s Privacy Policy.
The video created via the Activity and all stored information, including any personal information, received from a User remains the exclusive property of FAMILY and is not sold or distributed. Such information is stored in an industry standard secure location and any personal information is only accessible for as long as is necessary to fulfill the purposes for which it is collected, and it is destroyed in a manner which ensures that the private and/or confidential nature of the information is preserved.
2. What We Do With the Activity Video
Any video that a User records as part of the Activity through the interface provided on the site will be stored with a secure third party video service for moderation and playback. The third party service is bound by the Terms of Use and act on behalf of Family. All videos posted to the site must be submitted with a signed consent form for each person who appears in the video. The consent form must be signed by the participants appearing in the video OR by the parent/legal guardian of the participants appearing in the video if the participants are under the age of majority in his or her province. If FAMILY has not received a signed consent form for each person in the video, the video will be permanently deleted as described below.
A video recorded and submitted by User for moderation with a signed consent form is stored until it is moderated, and then will either be:
a) securely retained by FAMILY in perpetuity once approved, or
b) permanently deleted within 48 hours once rejected.
A video that has been recorded but not yet submitted by the User will be securely stored until submitted with signed consent form for a maximum of 48 hours. If the video is not submitted with the appropriate number of consent forms within 48 hours, it will be permanently deleted.
3. Cookie Technology
Cookie technology is used on this site to maximize the site experience. For example, we may use cookies to keep track of a User's progress through the Activity. No personal information is gathered from these cookies.
4. Grant of Rights
By posting, uploading or submitting any material or content to this site or otherwise submitting any material or content to us, you automatically grant (or automatically warrant that the owner of the rights to such material or content has expressly granted) FAMILY a perpetual, royalty-free, irrevocable, non-exclusive right and license throughout the world to use, reproduce, modify, adapt, create derivative works from, publish, translate, license, transmit, distribute and otherwise exploit any or all portions of such material or content in any manner and media and by means of any technology now known or hereafter developed. In addition, you hereby irrevocably waive all so-called "moral rights" in any such materials and content posted, uploaded or submitted by you.
