FRUIT GUSHERS “BEWARE THE GUSH” CONTEST An entrant under the age of majority in his/her province of residence must have parent or legal guardian consent to his/her participation. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if proof of identification can not be obtained, the entry will be disqualified. The contact information collected by Family Channel Inc. (“Family”) with your entry will only be used to award the contest prizes. Family will not use this personal information for any other reason and will not otherwise disclose this personal information to any other party. All entries are the property of Family and will not be returned. There is a limit of two (2) mail in entries per person per day. One request per outer envelope. Mechanical reproductions void. All mail entries must be received by no later than Sunday, April 4th, 2010 at 11:59 pm EST Eligibility: The contest is open to permanent lawful residents of Canada only, excluding residents of Quebec and excluding employees (and their immediate family members or persons with whom they are domiciled) of Family, or General Mills Canada Corporation (Family and General Mills Canada Corporation collectively the “Sponsors”) and their respective member companies, affiliates and subsidiaries, and advertising and promotional agencies. The contest is subject to all applicable federal, provincial and municipal laws and regulations. Contest void where prohibited by law. Family, reserves the right to cancel or suspend this contest in the event of any accident, or administrative or other error of any kind. Entries must be received by post or email at Family by no later than Sunday, April 4th, 2010 at 11:59 pm EST. The Sponsors take no responsibility for entries that are lost, misdirected, delayed, incomplete, garbled or received after the contest deadline. Only one e-mail address and account may be used by any person to enter the Contest. There is limit of one (1) entry and one (1) bonus entry per person permitted per day. In the event that Family receives more than the permitted number of entries per person, per day, via either regular mail, or the above website, for the duration of the contest, Family reserves the right to void and destroy duplicate entries and that entrant may, at the discretion of the Sponsor, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Family reserves the right to disqualify all such contestants from future contests conducted by Family without further notice. By submitting a contest entry, participants agree to be bound by these rules. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. The Draw A random draw will be held at or around 11:00am EST on Friday, April 9th , 2010 at Family’s office located at 181 Bay Street, Brookfield Place, Toronto, Ontario, from all eligible entries received on or before the contest closing date. There will be one (1) Grand Prize draw and ten (10) Secondary Prize draws. The chances of being selected depend on the total number of eligible entries received by any of the methods of entry. Approximate Retail Value of each Secondary Prize is CDN $30.00 Acceptance of Prize Entrants selected as winners must correctly complete a mathematical skill testing question and must sign a declaration confirming compliance with the rules and regulations and acceptance of the prize as awarded, and a release form acknowledging the non-responsibility of the Sponsors, their affiliates and/or associates and their respective agents, employees and officers and directors with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the contest, prize, the acceptance, use, misuse, possession and delivery of the prize, printing errors, claims based upon publicity rights, defamation or invasion of privacy, prior to being awarded the Prize. If a winner is a minor, his/her parent or legal guardian must sign a declaration and release form on his/her behalf in order for the winner to claim his/her prize. Selected entrants will be notified by telephone or e-mail within five (5) days of the draw. Selected entrants will then have five (5) days following receipt thereof to contact Family and provide requested documentation to claim their prize. Should Family not receive confirmation within five (5) days, or should a selected entrant be unable to correctly answer the skill testing question or complete a declaration and release by the date specified, the selected entrant will be deemed to have forfeited any rights to the prize and a back up entrant will be selected from the same manner by random draw taken from the same pool of entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry. All prize taxes, if any, are the responsibility of the winner. Limit one (1) prize per person or household. The Sponsors will not be held responsible for the loss of prizes due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address. General All entries become the property of Family and will not be returned. Prize must be accepted as awarded and may not be exactly as shown. No substitutions are available. Family, in its sole discretion, reserves the right to substitute any portion of the Grand Prize or Secondary Prizes with a prize of equal or greater value. Prizes are non-transferable, non-refundable and are not redeemable for cash. Each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the contest and accepting a prize, the winner or parent or legal guardian of the winner hereby consents to the reasonable use by the Family of the winner's photograph, voice, likeness and/or image, contents of the entry form and the name and age of the winner without any further compensation for any future promotional activity. Sponsors make no representation or warranty that any identification, photograph and/or likeness of the winner will be broadcast or used otherwise in any manner. Each entrant consents and agrees to the Sponsor’s collection and use of the information provided by the entrant for the purpose of conducting and administering this Contest. Each entrant agrees to be bound by these Contest Rules and Regulations. By entering the Contest, entrants agree that the Sponsor shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Contest or acceptance, possession and/or use or misuse of the prize, and agree to release, discharge and hold harmless the Sponsor and its respective officers, directors, parent companies, subsidiaries, affiliates, related companies, advertising and promotional agencies, third party services’ providers and prize suppliers (collectively, the “Releasees”) from all claims or damages arising out of entrant’s participation in the Contest and/or acceptance, use or misuse of any prize. The Sponsors are not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations. Family reserves the right to cancel or suspend the contest should a virus or any other factor beyond Family’s control corrupt the security or administration of the contest. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Family reserves the right, in its sole and absolute discretion, to cancel, modify or suspend a contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Family reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
